Why This Matters
When we pay our insurance premiums, we expect coverage when something goes wrong. This includes situations like a car accident, property damage, or a medical emergency. But far too often, policyholders are met with delayed payments, unexplained denials or settlement offers that fall far short of what they’re owed.
Under current Michigan law, insurance companies face little consequence for delaying or denying valid claims. Even when a policyholder is forced to take legal action and ultimately wins, the insurer often only has to pay what it should have paid in the first place. This creates little incentive for insurance companies to act fairly from the start.
Senate Bill 245 would change that by holding insurers accountable for bad faith practices such as unjustified delays, blanket denials without proper investigation and lowball settlement offers. It would also allow policyholders to recover additional damages when they've been harmed by these tactics.
Opponents of the bill argue it could increase premiums or lead to more lawsuits. However, similar protections already exist in most other states, without the negative outcomes the insurance industry often predicts.
At its core, this legislation is about accountability. Policyholders uphold their end of the bargain every day by paying premiums. The law should ensure insurance companies do the same when it matters most.
