$300,000 Settlement | Winter Storm Slip & Fall

A winter storm that dropped nearly 10 inches of snow created dangerous conditions across roads, sidewalks, and parking lots throughout the area. But severe weather does not eliminate a property owner’s responsibility to take reasonable steps to protect customers and visitors from preventable hazards.

In a recent case handled by Moss & Colella, P.C., our client suffered a fractured patella after slipping and falling at a gas station during the storm. The property owner claimed it had taken appropriate action to address the snow and ice accumulation and argued that the conditions were unavoidable because the storm was still active.

The evidence revealed otherwise.

Through litigation and cross-examination, we carefully analyzed the defendants’ own weather records and maintenance claims. Those records exposed a significant gap between what the gas station said it had done to make the property safe and what conditions on the ground actually showed. Despite the ongoing snowfall, the evidence demonstrated that reasonable safety measures had not been taken to reduce the danger to customers entering the property.

Premises liability cases involving active winter weather are often heavily contested, making detailed investigation and strategic preparation critical. In this case, that work resulted in a $300,000 settlement for our client — a significant recovery given the circumstances surrounding the active storm event.

When property owners fail to uphold their duty to maintain reasonably safe premises, accountability matters.
